A criminal conviction can change the rest of your life and you deserve an aggressive defense lawyer at your side. We are available at all hours if police emergencies arise, and attorney Giustino Capodilupo will make visits as necessary to the local jails to advise clients who have been arrested but have not yet obtained bail.
Our first goal in criminal defense cases is to have our client released from jail after an arrest. We will then conduct an independent investigation into the case against our client looking for reasons the criminal charges should be dismissed or lessened.
Drug possession penalties in Connecticut vary depending on the type and amount of the drug the defendant has in his or her possession at the time of the arrest. Penalties can also increase if any drug paraphernalia is found or if there is a school within a certain distance at the time of the arrest. We have defended our clients with possession charges for all types of drugs, including, but not limited to Marijuana, Heroin, Cocaine, Prescription drugs, Meth and Ecstasy.
It is common for police to pull individuals over for a traffic violation and then conduct searches of automobiles to find illegal substances. The best thing you can do is to tell the police that you want to speak with your attorney. All too often individuals make incriminating statements believing they are helping themselves, as the police tell them cooperating is the best thing they can do. Do not believe them. The police will attempt to have you incriminate yourself prior to arresting you. In this instance your Miranda Rights are not in effect because you are not under arrest. You will need a solid criminal defense. Say nothing to the police.
Theft and Burglary
Theft crime punishments are all relative to what was taken and its value. There are different degrees of larceny in Connecticut, ranging from first-degree larceny to sixth degree. If convicted of first-degree larceny (stealing more than $10,000 worth of property), one could serve up to 20 years in prison and pay fines in excess of $15,000. It is important to have a skilled and proven criminal defense attorney in your corner in order to fight these charges and keep you out of jail.
Burglary crimes are considered felonies and always carry strict consequences. A burglary charge can also carry charges of breaking and entering in addition to the crimes of stealing whatever was taken. Facing multiple charges can increase the penalties. Giustino Capodilupo will be by your side throughout your entire case, fighting the prosecution at every corner. Whether your child has been accused of stealing or you are the person who is facing prosecution, we can help.
Our law firm has the experience required to effectively guide you through the court process. We negotiate with prosecutors and, if negotiations fail, take your case to court and argue in front of the judge. You can rely on us to uphold your rights and build the best case we can for you.
DUI (Driving Under the Influence)
In the state of Connecticut, a DUI charge involves 1) a court proceeding to determine what penalties to impose if you are found guilty of driving under the influence and 2) the Department of Motor Vehicles will make a determination as to the suspension of your driver’s license.
Driving under the influence includes both alcohol and drugs. The penalties very depending on the charges and the substances that have been ingested. Minimizing the consequences is an important factor in good criminal defense. There are first, second and third offenses that carry with them increasing penalties regarding jail time, fines, license suspensions, possible community service and permanent revocation of your driver’s license.
A number of factors can compromise a DUI arrest — the Breathalyzer used may be calibrated incorrectly, a field sobriety test might be conducted improperly, or an officer may lack reasonable suspicion (probable cause) to pull someone over. In challenging DUI charges Giustino Capodilupo requests a copy of the maintenance record of the Breathalyzer used, a copy of the arresting officer's dashboard video of the pullover, and when a blood or urine test is used, that an independent lab test the sample as well.
Refusing to submit to a breath, blood, or urine test will result in a per se conviction.
"I was arrested for driving under the influence and my life and my family's life were turned upside down. I had heard that Attorney Capodilupo was an excellent lawyer and I contacted him. From the moment he and I met I knew I was dealing with someone who really knew his stuff. After we discussed the situation I was in and the likely consequences I was facing, he put me at ease. He knows the system and knows the courts and players. I couldn't have asked for better representation and he explained every step to me. He cared about what happened to me. He was able to get the charges dropped when he learned the police did not follow proper procedure. Without a doubt I will continue to recommend Giustino to my family, friends and acquaintances."
I was referred to Giustino Capodilupo because I was charged with drug possession. The person who referred me said "If you're in trouble with the law, this is the guy you want on your side." There were 12 charges against me. Attorney Capodilupo was able to get 11 of them dropped. He is a lawyer who knows what he is doing, and I highly recommend him. I would trust no one else to represent me"
"Out of the blue, I received an alarming phone call notifying me that my 25 year old son was in jail. He did something wrong by trying to take the law into his own hands. My son was living in another town, he was very naive, and petrified by the situation. To make matters worse, while in jail, my son was attacked! I was frantic and went to seek legal counsel from Attorney Capodilupo. He immediately drove to the jail my son was in and reassured him that everything would be okay. He then insisted that my son receive a professional evaluation. My son was later diagnosed as bipolar and treated immediately. Attorney Capodilupo then went to court and defended my son as if he were his own. He insisted that some unfair charges be dropped. After court, he drove my son home and gave him money from his own wallet. To this day, my son calls Attorney Capodilupo "The Man," however, I refer to him as the best attorney in the area."
"I just want to thank you for representing me and my family at a crucial time in my life when I thought there was no hope. You worked the system to our favor and the outcome was as stunning as your reputation. A Good Lawyer. Giustino Capodilupo the best attorney in Fairfield County."
I have had the experience to work with numerous attorneys through my professional career as well as several occasions in my personal life and I can say, without a shadow of a doubt, that you are by far the best attorney I have ever worked with. Thank you for always listening to me, supporting me, and sometimes offering some much needed therapy. I am so very grateful. "
